Multiple attempts to obtain clarification or communication from the owner or any representative have resulted in no response, misleading or incomplete information, denial of basic property-related details, and no accountability. This absence has created unfair treatment, operational instability, and preventable risk for both tenants and businesses.

3. MIXED-USE PROPERTY REQUIREMENTS

The property contains two legally registered businesses: Yogeeta Trucking and Future Octave Records LLC. Mixed-use properties require a responsible on-site manager, clear communication channels, oversight of safety and compliance, and a designated point of contact for tenants and agencies. At this time, none of these requirements are being met by the property owner.

4. ACTIONS TAKEN BY JOHNNY MORALES

As the Registered Agent for Future Octave Records LLC and the only responsible party consistently present on-site, I have monitored and maintained the property, responded to tenant questions and concerns, documented communications and incidents, provided accurate information to agencies, ensured safety and operational continuity, and cooperated fully with Housing Authority and Civil Rights Department inquiries. These actions have been taken voluntarily to prevent further disruption and to protect the safety of those on the property.

5. REQUEST FOR INTERIM APPOINTMENT

Due to the ongoing absence of a landlord or responsible agent, I am formally requesting recognition as the interim property-management contact under agency oversight. This request is based on my legal status as Registered Agent for a business registered at this property, my consistent presence and responsibility on-site, my documented efforts to maintain stability, and the complete lack of any active landlord fulfilling required duties. This request does not seek ownership – only temporary authority to ensure compliance, communication, and safety.

6. RECENT DEVELOPMENTS

Recent developments include continued lack of response from the property owner, tenants reporting confusion about who to contact, agencies requesting clarification due to conflicting information, ongoing need for a responsible point of contact, and increased urgency due to unresolved management issues. These developments reinforce the need for immediate administrative intervention.

7. UNAUTHORIZED MONITORING & REQUEST TO DISABLE CAMERAS

The property's security system, including Vivint cameras and monitoring features, was installed and activated without any signed authorization or consent from the individuals currently residing at or operating businesses on the property. No tenant, business operator, or on-site responsible party has ever been provided a monitoring agreement, a consent form, a disclosure of who controls the system, a written explanation of how footage is stored or accessed, or any documentation identifying an authorized account holder.

Because no one on-site signed or approved monitoring, the current operation of the cameras raises serious concerns regarding privacy, unauthorized surveillance, misuse of access, lack of accountability, and safety of tenants and businesses. Additionally, with no active landlord or responsible agent, there is no verified party with legal authority to operate or monitor the system.

To prevent further confusion or potential misuse, I will be submitting a formal request to Vivint asking that all camera monitoring be suspended, remote access be disabled, and no changes to the system be allowed until a verified, authorized, and legally responsible party is established. This request is being made solely to protect the privacy and safety of tenants and businesses and to ensure that no unauthorized individual is monitoring, accessing, or manipulating the security system.

I certify that the information in this report is true and correct to the best of my knowledge and is submitted in good faith for agency review.

9. ASSERTION OF RIGHTS & SIX-MONTH PROTECTION AGAINST UNLAWFUL DETAINER

Johnny Morales and Angelica Larson have formally asserted their rights as tenants under California law, including rights related to habitability, proper notice, due process, and protection from retaliatory conduct. These rights were asserted after repeated failures by the property owner to provide required information, communication, or legally mandated documentation.

Under California Civil Code and related housing protections, when tenants assert their rights in good faith – including reporting issues, requesting repairs, or challenging improper actions – the property owner is prohibited from filing a retaliatory unlawful detainer action for a period of six (6) months following the assertion of those rights. See: California Civil Code §1942.5 .

Because Johnny Morales and Angelica Larson asserted their rights within this protected period, Yogeeta Prasad is legally barred from filing or pursuing an unlawful detainer action for six months from the date those rights were asserted. Any attempt to initiate or continue an eviction during this protected timeframe may be considered retaliatory and invalid under California law.

This statutory protection exists to ensure that tenants are not punished for exercising their lawful rights, particularly in situations involving habitability concerns, lack of utilities, or failure by the property owner to provide required disclosures or management oversight.

10. OWNER'S FAILURE TO OBTAIN REQUIRED LICENSES, PERMITS, AND REGISTRATIONS

The property located at 16118 Adobe Way, Lathrop, California, is a mixed-use site containing both residential occupants and registered business operations. Under the City of Lathrop and San Joaquin County regulatory requirements, any owner who rents rooms, operates a rental business, or collects rent from multiple tenants must maintain proper licensing, registration, and zoning compliance.

At this time, there is no evidence that Yogeeta Prasad holds the legally required City of Lathrop Business License to operate rental activity, nor is there evidence of a San Joaquin County rental property registration for this address. Additionally, because the property is used for both residential and commercial purposes, the owner is required to maintain appropriate mixed-use zoning compliance, including any necessary Certificates of Occupancy, Conditional Use Permits, and fire and safety approvals.

The owner does not reside on the property and has failed to designate a responsible local agent, as required for off-site landlords. This failure has resulted in the absence of any on-site management, oversight, or compliance monitoring.

Operating an unlicensed rental business, renting rooms without proper authorization, and failing to maintain required permits renders the owner out of compliance with local and county regulations. As a result, the owner may not legally collect rent, issue valid notices, or initiate an unlawful detainer action. Any attempt to evict tenants or demand rent while operating without the required licenses and registrations is defective and may be considered invalid under California law.
