Re: Cease and Desist – Defamatory Statements
Dear Mr. Mena,
This notice is issued on behalf of Future Octave Records, LLC (FORLLC) and its founder, Johnny Albert Morales. You are hereby directed to immediately cease and desist from making and publishing false, defamatory, and harmful statements about Mr. Morales and his family. This demand extends to all affiliates, collaborators, representatives, agents, and associated entities acting on your behalf or in concert with you.
Specific defamatory conduct
Publicly referring Mr. Morales to be a “drug addict” and “dope head,” and making disparaging remarks about his father, John A. Morales. These statements are categorically false, malicious, and damaging to personal reputation and the professional interests of FORLLC.
Applicable law (California)
- Civil Code §§44–46: Defamation includes libel (written) and slander (spoken); false and unprivileged statements that injure reputation.
- Civil Code §47: Malicious falsehoods are not privileged.
- Civil Code §48a: Failure to retract defamatory statements after notice increases liability for damages.
- Business & Professions Code §17200: Prohibits unfair business practices, including conduct that interferes with professional activities.
Demands
- Cease and desist: Immediately stop all further false or defamatory statements regarding Mr. Morales, his family, or FORLLC.
- Retraction: Issue a full retraction in the same forum(s) where the statements were made, with equal prominence.
- Written assurance: Provide written confirmation of compliance within 10 days of receipt of this notice.
Notice of consequences
Failure to comply will result in pursuit of all available legal remedies, including claims for general and special damages, punitive damages, injunctive relief, and recovery of attorney’s fees, against you and any affiliated parties involved.
